Essential guidance on The Trade Union and Industrial Relations Acts in Ireland
Since the publication of the fifth edition in 2015, there have been a number of significant developments in this area, both legislative and judicial. These include the enactment of the Industrial Relations (Amendment) Act 2019, giving members of An Garda Síochána access to the Workplace Relations Commission and the Labour Court, and the Workplace Relations (Miscellaneous Provisions) Act 2021, addressing the issues raised by the Supreme Court decision in Zalewski v An Adjudication Officer (2021).
This new edition brings you up to date by examining the impact of these developments which, in addition to the 2019 and 2021 Acts, include:
- The Supreme Court decision in NECI (2021) upholding the constitutionality of the SEO provisions in the Industrial Relations (Amendment) Act 2015.
- The Court of Appeal decision in Mullally (2016) confirming that industrial relations decisions of the Labour Court are not amenable to judicial review.
- Trade Union (Forms) Regulations 2018 and Trade Union (Fees) Regulations 2018.
- The establishment of JLCs in the English Language Schools and Early Years Care sectors and the amalgamation of the two regional catering JLCs.
- Labour Court recommendations in Freshways Food, Enercon Windfarm, Conduit Enterprises, Zimmer Orthopaedics and Scruttons.
- New Labour Court Rules.
Each Act and statutory instrument is annotated with reference to relevant case law, books, articles and parliamentary debates. All textual amendments, adaptations and repeals are clearly shown as the legislation is thoroughly cross-referenced.
