New 4th Edition

The 3rd Edition of this book has been described by the High Court of England and Wales as "the leading academic authority" in the field and as a "highly persuasive" authority for the courts, and it is frequently cited by judges in both the English and Irish courts (as well as numerous other courts and tribunals across Europe).

The 4th Edition will provide comprehensive coverage of the English law of public and utilities procurement, as well as an overview of the position in Scotland, Wales and Northern Ireland. It provides a detailed analysis of the new Procurement Act and its related guidance, which usher in a radical set of reforms to the way procurement is regulated. The book includes full explanations of where the law under the new Act differs from the previous law and considers for each issue how far earlier case law is still relevant. There are several chapters analysing the new award procedures (open procedure, competitive flexible procedure and direct award) as well as extensive separate chapters covering topics such as:

  • Social value
  • Pre-market engagement and drafting specifications
  • Dynamic markets and framework agreements
  • Contract management, including modifications to contracts
  • The new information regime and supplier registration system
  • Exclusion and debarment
  • Supplier remedies and other enforcement mechanisms

There are also separate chapters looking at utilities, the defence sector, the health sector, and local government.
