The IDS Employment Law Handbook, ‘Disability’ (2023), is a new addition to the IDS Handbooks range. The development of this Handbook reflects the fact that disability is increasingly seen as a discrete area of expertise and practice within the field of discrimination generally, given the large body of case law in this area. This Handbook accordingly focuses on the disability-specific provisions of the Equality Act 2010, in particular the definition of ‘disability’, the duty to make reasonable adjustments, and the concept of discrimination arising from disability. The detailed treatment of these topics is based on chapters formerly contained in the IDS ‘Discrimination at Work’ Handbook, which have been extensively revised and updated. The Handbook also explains, among other things, how other forms of unlawful discrimination under the 2010 Act apply in the particular context of disability; the circumstances in which disability discrimination might occur before, during and after employment; the restriction on employers asking pre-employment health questions; and the disability-specific exemptions from liability under the 2010 Act.
